NEW YORK, Nov. 6, 2026 — A federal judge has refused to throw out a proposed class action that says Delta sold “window” seats sitting next to a blank wall.

The ruling

  • Judge: Ramon E. Reyes Jr., U.S. District Court for the Eastern District of New York.
  • Ruled: Wednesday, Nov. 4, 2026. He denied Delta’s motion to dismiss Meyer v. Delta Air Lines.
  • Key finding: the breach-of-contract claims are not preempted by the Airline Deregulation Act.
  • Delta’s argument: its Contract of Carriage does not promise a window.
  • Aircraft named: 737s, 757s and A321s.
  • Who’s covered: Simple Flying says more than 1 million flyers.
  • Lead plaintiff: Nicholas Meyer, who paid extra for seat 23F on a 757-200.
  • Plaintiffs’ attorney: Carter Greenbaum said: “They sold customers window seats and ended up seating them next to a wall.”
  • Related case: a similar suit against United was allowed to proceed in July.
  • Timeline: the suit was filed Aug. 19, 2025. Trial date: TBA.

Why it matters to airline people

There’s no direct non-rev effect. The case could change how airlines label and sell seats on their seat maps, which matters to commercial and airport teams. For your own trips, check a seat map that shows window positions before you pick a “window” on these aircraft types.
